SUMMARY

Each people, race or group has their own ways of doing things especially as they concerned conflict resolution. While in Europe, for example, the police are the agency of crime detection, several African societies (including Benin Kingdom) relied on oath taking and divination in pre-colonial times. While the Western world placed emphasis on a judicial system presided over by lawyers and judges, the traditional Benin Kingdom used council of elders, Oba’s court and so for dispute settlement and justice dispensation. The traditional ruler with executive, legislative and judicial powers constituted the court, and as noted by Gluckman, the objectives of the courts are to right the wrong, adjust claims, defend norms and prevent good relationship from being broken.
