ABSTRACT
The Second Republic featured a judiciary constrained by the military and the political class from effectively carrying out her functions. Unlike any other period in the history of the Nigerian state, the Second Republic is sandwiched between to lengthy military rules.
The influence of the military was therefore bound to influence the outcome of judicial activities of the period. It was therefore not surprising that the decisions of the courts in the period appeared to fluctuate between efficient justice delivery and keeping the polity calm by delivering judgements in favour of the political class, or the military.
