All over the world, the problem of infertility has led most women into a depressing state. Women who battle with infertility often look for an alternative method to procreate. The innovation of technology has made procreation easy for women who battle with infertility, with the aid of surrogacy. The concept prescribes a method which allows couples to give birth to a child through the use of a surrogate mother. Surrogacy has gradually found it’s way into the medical system of countries, however, most countries have failed to accept the concept of surrogacy while in some countries, although surrogacy is practised, there are no laws guiding the practice of surrogacy.
There have been issues that have been raised as to the legality of surrogacy in Nigeria. Surrogate agents and infertility clinics are known to be established In the country but there are contentions as to it’s legality. The concept of surrogacy is known in the Nigeria but it lacks a legal framework to regulate the practice in the country. This paper shall look at the legality of surrogacy in Nigeria and if there is a legal framework.
Basically, this essay will look at the practice of surrogacy in Nigeria and its history. We shall draw a comparative review of the concept and practice of surrogacy in other countries looking at the legal framework of surrogacy in these countries. The concept of surrogacy in Nigeria is not generally accepted because of the diverse nature of the country. This paper shall reasons why surrogacy needs to be accepted generally and why it is important for a legal framework to be established in the country.
