ABSTRACT

This work titled “The Challenges Confronting the Independence of the Nigerian Judiciary”, aims at examining the contemporary issues confronting the judiciary that hinders the institution from performing their duties independent of other organs of government. It tends to point out that the menace in our judicial institution is as a result of the challenges that confronts it which would be seen in our subsequent discussion. A prominent contribution on this work is to provide analysis of the question of an independent judiciary in Nigeria. It discovers that even though the Constitution of the Federal Republic of Nigeria guarantees one’s right to have one’s case heard by an independent and impartial judge, it does not guarantee institutional independence of the Nigeria judiciary and this could be the reason why the Nigerian judiciary is declining and its compelled by lack of constitutional guarantee to always beg either the executive or the legislature for one favor or the other.
