ABSTRACT

Eviction is one of the major housing problems in Benin City. An untold number of Nigerians gets evicted from rental houses each year. This study examines Eviction in Residential Tenancies in Benin City. This was with a view of conducting detailed examination on the causes and methods of residential tenant eviction. To achieve this, data was collected from primary and secondary sources. The simple random sampling technique was used to select respondents and a sample size of 130respondents was selected. The secondary data were reviews of literature from books, journals and other academic materials. Data obtained were analysed through the use of frequency count to rate the respondents bio-data, mean item score to rate the major causes of tenant eviction and the Relative Importance Index was used to access the most adopted method of residential tenant eviction in Benin City. It was found that rent default was the major cause of eviction. Also there are laws and policies setup for tenant eviction and which are also against forced eviction. The Interpersonal resolution is the most adopted method of residential tenant eviction as litigation process proof to be time and money consuming. It was recommended that awareness should be created by government to educate people on tenancy laws. Alternative dispute resolution such as arbitration, mediation, reconciliation and med-arbitration should be adopted by the estate surveyor and valuers in resolving dispute between landlord and tenants that may lead to eviction.
