ABSTRACT

Given that it revolves around people’s lives and wellbeing, the healthcare profession is highly esteemed, recognized and revered. These professionals are called upon when individuals become ill and undertake to use all of their abilities and experience in order to make these ailing persons well again. Sadly, Nigeria’s healthcare system has historically found it difficult to deliver to patients’ excellent medical treatment. Medical negligence has become the order of the day and the lives of patients are put at high risk because of it. Medical negligence as a phenomenon is caused by several things. Firstly, the ill equipped state of our hospitals, lack of or poor iinfrastructure, but most importantly, the careless attitude of these medical practitioners in diagnosing, treating or carrying out operational procedures on patients. To solve this problem, it is therefore recommended that this stringent proof of a medical practitioner's liability by the patient with expert evidence be reduced, that stiffer penalties be imposed on these negligent medical practitioners to serve as a deterrent to others and that hospitals must be well equipped with standard tools to enable these medical practitioners perform their duties efficiently.
