ABSTRACT

This essay seeks to examine the liability for defective goods produced and services rendered to consumers. Thus the essay explores the provisions of the sales of goods act by defining defective goods and services and also outlining the rights and protections of the consumers. The goal of this research project is to investigate the legislation pertaining to the sale of defective goods and services. We must therefore comprehend and become aware of their legal obligations and liabilities under the law. It is however very regrettable that merchants and service providers in Nigeria do not give consideration to the safety of customers and those who need their services. This essay is also concerned with the regulations regarding transactions with both the consumers and the producers, should the products consumed or the service rendered be defective in any way. These regulations we would be examining are all however embedded in the provisions of the sale of goods act and as such we would therefore streamline our work towards the provisions clearly elucidated and posited under the Sale of Goods Act 1897. The research methodology will therefore rely on a combination of primary and secondary sources, including doctrinal research methods, statutes, case laws, online resources, textbooks, journals and articles relevant to the subject matter.
