ABSTRACT

The reason this essay entitled, Legal Aid in Nigeria: Problems and Prospects which is aimed at the adequate grant and administration of Legal Aid to indigent citizens as examined in this work was to ensure rule of law, fair trial, protection of fundamental human right and proper justice to both the poor and rich alike are protected irrespective of their station in life because Legal Aid is a process of assisting indigent citizens with legal aid services to enable them prosecute or defend their cases in the country's judicial system because litigation is a very expensive thing and persons of insufficient means may find it difficult to defend their matters in the court to a successful conclusion. Justice may never be available to most indigent persons who cannot afford the high cost of litigation. Hence, the idea of providing some kind of legal assistance to indigent persons to enable them pursue their legitimate claims to justice in the country's judicial process is therefore a sound social policy worthy of serious attention by any government that cherishes the rule of law and equality before the law in the administration of justice for every citizen of Nigeria. The approach in this research project is doctrinal method, with analytical method for legal research which aided the process of writing this work to its approval. The work looked at the problems affecting the grant of Legal Aid in Nigeria such as poverty, poor funding and lack of legal information and proffers for the prospects. The work further stressed that, the Nigerian Bar Association and other government agencies should strive at having a human rights Committee in every state of the Federation, which would speed up the process of justice to the indigent citizens who cannot pay for service of legal practitioners. The government must also work relentlessly towards promoting the economic well-being and social growth of the citizenry for a solid crime free society at large where justice, equity and fairness would prevail.
