ABSTRACT
The Land Use Act is a crucial legislation that governs land transactions and ownership in the country. Ever since the consent requirement of the Land Use Act was brought before our courts for interpretation in the case of Savannah Bank v. Ajilo[1], much juristic ink has been expended in debate for or against the usefulness of the provisions. Understanding the consent requirements for land alienation is vital as it ensures fairness, transparency, and protection of individuals' property rights. The study examines the stance of the apex court regarding the consent requirement for the alienation of land use. By analyzing recent judgments, the research aims to provide insights into the court's interpretation and application of the consent requirement provisions. This analysis will shed light on the legal framework surrounding land transactions and help identify any emerging trends or changes in judicial interpretation. Additionally, the research explores key provisions of the Land Use Act that pertain to the consent requirement. This includes a thorough review of relevant sections and regulations to understand the scope and implications of the consent requirement for different types of land alienation, such as sale, lease, mortgage, and assignment. The findings of this study will be beneficial to various stakeholders, including landowners, buyers, policymakers, legal practitioners, and scholars. It will provide a comprehensive appraisal of recent decisions, offering valuable insights into the evolving landscape of land transactions under the Land Use Act. Ultimately, this research aims to contribute to the development of a fair and efficient land administration system in Nigeria.
