ABSTRACT

The Land Use Act is a crucial legislation that governs land transactions and ownership in the country. Ever since the consent requirement of the Land Use Act was brought before our courts for interpretation in the case of Savannah Bank v. Ajilo[1], much juristic ink has been expended in debate for or against the usefulness of the provisions. Understanding the consent requirements for land alienation is vital as it ensures fairness, transparency, and protection of individuals' property rights. The study examines the stance of the apex court regarding the consent requirement for the alienation of land use. By analyzing recent judgments, the research aims to provide insights into the court's interpretation and application of the consent requirement provisions. This analysis will shed light on the legal framework surrounding land transactions and help identify any emerging trends or changes in judicial interpretation. Additionally, the research explores key provisions of the Land Use Act that pertain to the consent requirement.
