ABSTRACT
This work examines the challenges posed by the Land Use Act to effective housing in Nigeria. This is done with regards to the control and management of land in Nigeria. it further examines the rights of citizens to own property in Nigeria, rights that are constitutionally guaranteed to all citizens. In light of this, the study examines the various problems of the Act that range from the powers vested in the State Governor. The Promulgation of the Land Use Act was borne out of the necessity to generally achieve an efficient Land Use Act, management and control. There would have been no need for the Land Use Act if the various land laws pre-existing the Act, were able to address the problems associated with the use of land. However, the Land Use Act which later came as a respite, also falls short of expectations and becomes defective in addressing the problems of land use in Nigeria. This is due to the controversies and ambiguities plaguing its various provisions. The concern of this research work is to investigate some of such problems and their effects on achieving effective housing which is supposed to be the right of every citizen. Some of these problems that will be examined will include; the Governor’s power, vesting of all lands in him, compulsory acquisition, designation of urban areas, inspection of land, granting of statutory and customary rights, revocation of statutory and customary rights and the consent provision. The work will also examine the various housing policies put in place by government to address the problem of housing. The research adopts the doctrinal methodology in examining both primary and secondary sources. It holistically appraises the problems of the Act. The research also covers the recommendations made by the author. These include the reversion of the old system of communal holding of land which was governed by the traditional institution and as well as the repeal of some of repugnant sections of the Act. The author also recommends constant organization of seminar, symposium and lectures by the judicial officers to public workers in the Department of land in all States of the Federation, among others.
