ABSTRACT
Human rights are rights that are fundamental to all human beings, regardless of race, sex, ethnicity, language, nationality, religion or any other form of status. [1]
The study of the fundamental nature of human rights answers the questions about existence, content, justification, nature, universality, and legal status of humans themselves to bring, protect the interest of humans even at all levels and also all sectors.
Human right of women on another hand is a branch of human rights and it addresses the special interests and peculiarity of women across all races, religion, ethnicity and the general involvement of women in the society. Due to the peculiarity of women and the discrimination of women across all sectors, the need to address the rights of women as separately distinct from the general definition of human rights was birthed.
This research work is poised to distill the concept of women’s right as it relates to economic and social rights of women within Nigeria.
This paperwork intends to analyze the subject on laws for the protection of women’s Rights and the functionality of these laws in Nigeria with Global interests, recognition and how these laws guarantee the rights of the women in Nigeria.
It is evident that women have been generally discriminated against by virtue of our laws and customs which are reflected heavily in the society portraying women as weak and incapable of taking a lead role in certain facets of the society. While it may not be factually wrong to an extent that women are physically weaker than their male counterparts, it should not be a medium for prying down on women and their associated basic rights. This and many more formed the need for the establishment of women’s right as important by the United Nations to carter for the protection of Women’s rights and the legalization of their rights because women’s rights and human rights. These rights are such that should be regarded and protected like every other universally accepted human right. These include: basic education, freedom from slavery, discrimination, right to own property and so many others.
The overall aim of this research work is to highlight these laws and suggest ways to foster a proper and more robust implementation of these laws where necessary.
AIMS AND OBJECTIVES:
The aim of this study is to expose the trajectory of the women’s right movement, the laws that have been put in place to ensure the adequate protection of women’s right in both social, economic, and cultural sectors and how these laws can be used to guarantee a holistic regard for women’s right in Nigeria.
The objective of this research work is to shed more light on the rights of women, especially those in Nigeria and how a proper legal framework and its accompanying functionality can guarantee the essential protection of women’s rights in Nigeria.
METHODOLOGY:
This study will utilize doctrinal research. It will analyse and evaluate information derived from primary and secondary sources, international treaties and national legal instruments including the 1999 Constitution of the Federal Republic of Nigeria (as amended), and other relevant laws, textbooks, journals, judicial pronouncements, seminar research materials and other relevant literatures sourced from reputable law libraries.
