ABSTRACT

The plight of internally displaced persons is a global headache. This research work examines the plight of internally displaced persons in Nigeria. They face challenges such as malnutrition, instability, illiteracy, etc. Nigeria has no legislation that deals explicitly with IDP’s and no organization equipped to handle IDPs at present. There still remains legal and policy challenges in protection and assisting IDPs in Nigeria and there is a need for States to apply the African Convention for the protection and assistance of IDPs. IDPs are maltreated in an inhuman and degrading manner, self-degrading and their rights are not recognized in the society. These persons face physiological, societal, health and economic effects. They face trauma of losing their homes, loved ones and their means of livelihood. They are affected with sickness that takes effect in later years to come. The policy set by the Nigeria government for the protection of internally displaced persons in Nigeria that have not been signed by the State. It focuses on the institutional framework that also aids the legal framework in the protection of IDPs from the threat of their lives. It has been revealed in this work that there are laws that fight against plight and that supports States in the protection of IDPs. In furtherance of this work, the effectiveness of these laws and conventions are examined as well as the challenges of IDPs. Finally, recommendations are provided for in this research on how the State and legal framework can be more effective so as to reduce the occurrence of abuse in the rights of IDPs, curb it’s widespread and preserves lives and destinies from death and a call on Nigeria to domestic the Kampala Convention in regards to the protection and assistance of IDPs.
