ABSTRACT

Trade the subject of discussion is one of the oldest venture which can be traced back to the early men. It is the interaction of State parties or private individuals and State parties with the common goal of profit making. At some point in human history, it has been ascribed with different names_ trade by barter, merchantilism, commercial transaction and a host more. One thing that has remained constant is the existence of ‘’exchange’’ and such ‘’exchange’’ is a determined by contracting parties. International trade law is that law that creates a conducive atmosphere for peaceful and fair trade between countries. It is that law that co-ordinates trading activities across borders. States have the right to create structures and national policies to regulate trading activities with the world, this is in line with the principle of State sovereignty. A State may adopt protectionism or trade liberalization as a trade policy for the safeguard of her economy. The focus of this study is to reveal the effect of protectionism as a challenge to the implementation of international trade law. The major sources to be engaged are: International trade laws, academic books, journals and articles in line with the subject matter.
