EXAMINATION OF ENVIRONMENTAL RIGHT AS HUMAN RIGHT

ABSTRACT

The Environment is a fundamental part of Human Right and Human existence. The discussion on the development of environmental human right has emerged only very recently in comparison to other human right. The academic changes for instance for the emergence of new sub-disciplines such as environmental sociology) along the institutional and legal movements opened the path for the debate on environmental human right. The research examines the relationship between human Right and Environmental Concerns and the Challenges/Limitations to the Protection of the Environment coupled with the legal framework for the protection of Human Right as far as the Environment is concerned. The study employed the doctrinal research method with the use of environmental Legal cases buttresses the legal framework the enforcement of Human Right generally. The research concludes by recommending a National consideration of the enactment of legislation binding and adopted at all levels recognizing the Environment as a fundamental of human existence and the recognition of Principle 10 of the Rio Declaration.
