ABSTRACT

This project undertakes a comprehensive legal analysis of the right to food security in Nigeria. It examines the International and regional legal frameworks, including the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the African Charter on Human and Peoples’ Rights (ACHPR), which Nigeria has ratified, and explores the country’s obligations to respect, protect, and fulfil the right to food.

This study investigates the domestic legal landscape, including the Nigerian Constitution, legislation, policies, and programs related to food security, highlighting the gaps and challenges in realizing the right to food. It also analyses the impact of food insecurity on vulnerable populations, such as women, children, and internally displaced persons (IDPs). This research employs a doctrinal and analytical approach, relying on primary and secondary sources, including case law, statutes, and academic literature. The study argues that despite the non-justiciability of the right to food in Nigeria, the government still has obligations to ensure food security, and that a rights-based approach is essential to address the country’s food security challenges.

This project proposes recommendations for strengthening the legal framework, enhancing food availability, access, and utilization, and promoting sustainable agriculture practices in Nigeria. The study contributes to the ongoing efforts to address food insecurity, promote sustainable development, and achieve the Sustainable Development Goals (SDGs) in Nigeria.
