ABSTRACT
This research work examines the effect of Oil Pollution on the environment and undertakes a comparative study of the legal framework for environmental protection in Nigeria and some other oil producing jurisdictions. Some jurisdictions were selected for this purpose. The legal framework for the prevention and control of oil pollution in these countries will be compared with the position in Nigeria. The study aims at analyzing the efficacy or otherwise of the extent Nigerian statutory framework vis-a-vis that of some jurisdictions with respect to the control of oil pollution. The study makes a case for an effective and adequate comprehensive body of legislations to deal with oil pollution as against the present situation of fragmented and often conflicting laws that are unable to deal with the problem in Nigeria. This work concludes that there are defects in the laws that regulate environmental pollution in Nigeria and there are also poor enforcement measures which are the reason for current level of oil pollution in Nigeria. This work recommends that the government should strengthen the existing laws, bodies/agencies concerned with oil pollution management and prevention to ensure the adherence and enforcement of the existing laws.
