ENVIRONMENTAL HEALTH IN NIGERIA: AN ANALYSIS OF THE NATIONAL ENVIRONMENTAL (ELECTRICAL/ ELECTRONIC SECTOR) REGULATIONS 2011

ABSTRACT

Environmental health in Nigeria has seen a good deal of significant growth from being almost nonexistent. Flowing from the fact that it was initiated in the colonial era during which environmental issues were generally included among public health regulation, and having developed in a rather ad hoc manner in the early days after independence during which grave dependence was placed on the law of nuisance, Nigeria now has a relatively comprehensive environmental law policy, having learnt lessons from the setbacks of its predecessor agency between 1991 to 2007. The National Environmental Standards and Regulations Enforcement Act 2007 and Regulations 2009 to 2011, were necessary.

This study employed the doctrinal approach in its research. It addressed environmental health in Nigeria by analyzing the electronic waste management and disposal policies in Nigeria, narrowing in on the National Environmental (Electrical Electronic Sector) Regulations 2011.

This study revealed that Nigeria now has a relatively comprehensive environmental policy adequately capable (to a reasonable extent) of ensuring effective monitoring compliance and enforcement of electronic waste management and disposal precautions thus safeguarding environmental health in Nigeria. It pointed out the setbacks present in the regulation and proffered recommendations which can be utilized to ensure better environmental health practices, while highlighting the need for focus on proper enforcement of the regulation.
