ABSTRACT

Environmental displacement is a process by which communities find the land they occupy, irrevocably altered in ways that foreclose or otherwise impede possibilities for habitation; and disrupt access to resources within spaces of life, work and social cultural reproduction. In Nigeria, environmental displacement is occasioned by sudden-onset and slow-onset processes; such as desertification, environmental degradation and natural disasters which include flooding in the North Central and North West areas, erosion in the South East, oil spillage, gas venting and development project in the South-South, Niger Delta region. The global and local impacts of environmental displacement have led to calls for the development of mitigating and adaptive regulatory framework towards curbing the impacts of environmental displacement. Attempts at regulating environmental displacement includes the ratification of the African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (otherwise known as the Kampala Convention), National policy on Internally Displaced Persons (IDPs) in Nigeria, National Disaster Management Framework and the establishment of the National Emergency Management Agency (NEMA) to manage disasters in Nigeria, as well as the formulation of policies relating to disaster management in Nigeria. The aim of the study is the examination of environmental displacement of person’s regulations in Nigeria using the doctrinal method of research. The study further examines the concept of environmental displacement of persons, the causes of environmental displacement of persons and the challenges of environmental displacement of persons. The study finds that environmental displacement of persons caused by natural or anthropogenic activities remain a major challenge to achieving global sustainability. The study further reveals that the National Emergency Management Agency (Establishment) Act and other Environmental protection regulations focuses more on the establishment and functioning of the agencies, development of action plans for mitigating, preventing or minimizing the risk of disasters rather than the welfare of environmentally displaced persons. 26 The study contributes to existing knowledge by recognizing the need to accommodate efficient tracking and the management of displaced persons within the legal framework for environmental protection in Nigeria.
