ABSTRACT

Domestic violence against women is a global issue that transcends national, cultural and class boundaries. It is a menace that is deeply rooted in the society and has led to the sudden death of women across the globe. This research examines the nature of domestic violence under the backdrop of current legal framework designed to safe guard women’s right in Nigeria. This research submits that domestic violence is one of the worst subjugations and oppression experienced by women and it manifest in many forms such as infliction of physical, emotional as well as sexual abuse, marital rape etc. this research further discovers that the laws protecting women against domestic violence in Nigeria are not only ineffective but grossly inadequate particularly when compared with similar legal frameworks in the United Kingdom. Furthermore, this work addresses the challenges faced in the implementation of the legal framework protecting women against domestic violence in Nigeria and factors that militate women access to justice. This work therefore recommends and concludes that Nigeria should enact an effective federal legislature and strengthen its enforcement mechanism, organize extensive orientation on the right of women and where and how they can enforce their right. Finally, this work calls on the Nigeria State to rectify and domesticate all international treaties and conventions on this concept.
