ABSTRACT

This research work examines some of the ways in which environmental and human rights are violated. It examines the effectiveness of the existing legal regimes and the challenges the laws face which hinders their applicability. Although, there are numerous legislations at both national and international levels for the enforcement of environmental and human rights, the environmental and human rights of communities and victims are still violated by the continuous pollution and degradation of the environment. This work examines the extent of the violation of these rights and addresses the inadequacy of some of these legal provisions and the difficulty in their enforcement. It analyses the effectiveness of the existing legal regimes. This research recommends that Public awareness, enlightenment programmes and orientation for the masses are needed. Establishment of environmental courts should be taken into consideration just like there are National Industrial Courts in the country. And concludes that Hence, if we fail to address the issues on the violation of environmental and human rights in our society today in adhering to state laws or international treaties signed by the states then we fail the victims who are being violated and the communities who suffer from the degradation of their environment.
