ABSTRACT

This paper examines the rights of internally displaced persons in Nigeria. Despite the Guiding Principles on Internal Displacement of persons and other international instruments, IDPs continue to face significant challenges accessing basic rights like shelter, healthcare, and education. This research adopts the doctrinal methodology and examines both primary and secondary sources in order to evaluate and confirm legal hypothesis. This research critiques the existing legal framework, analysing the shortcomings of national responses and the obstacles to effective implementation. This research finds that the provisions of the Constitution do not afford the internally displaced persons enough right with regards protection. The study also finds that IDPs face insecurity, violence, and harassment in camps and host communities. The efforts put in place by the international communities in ensuring that internal displacement is been curbed in Nigeria seems to be a myth rather than a reality in Nigeria considering harsh and unfavourable conditions the internally displaced persons go through. It recommends for a more robust and inclusive approach, prioritising the dignity, safety, and participation of IDP in decision-making processes. The paper concludes that by strengthening the protection of IDPs’ rights, the Nigerian government must prioritize the protection and assistance of IDPs, ensuring their safety, dignity, and well-being.
