ABSTRACT

This study examines the liability of employers to their employees in Nigeria, focusing on the legal framework, judicial decisions, and statutory provisions. The research explores the various aspects of employer's liability, including contract of employment, tortious liability, and statutory liability. The study adopts the doctrinal methodology and examines both primary and secondary sources in order to evaluate and confirm legal hypothesis. The study analyses the provisions of the Nigerian Labour Act, the Employee's Compensation Act, and the National Industrial Court Act, highlighting the rights and remedies available to employees. The study also examines the common law principles governing employer's liability, including vicarious liability, negligence, and breach of contract. The study argues that employers have a duty of care to their employees, and breach of this duty can lead to liability for damages, injuries, and other losses. The findings of this study is that employers have a responsibility to protect their employees from potential harm by effectively managing risks to their safety and well-being while at work.The study recommends stricter liability regimes to protect employees' rights and promote fair labor practices. The study concludes by stating that the Nigerian labour laws should be properly enforced and upheld by an impartial and incorrupt judiciary.
