ABSTRACT

This research work examines the legal framework protecting people from environmental degradation. This research shows that environmental degradation is an epidemic that is spreading widely affecting a great number of persons in various societies of the world today including Nigeria which is the focus of this work. The work further examines whether there are legal frameworks that have been enacted and incorporated to protect victims. It has been revealed by the work that there are laws but they do not protect victims in general. The legal framework in place include municipal laws, regional conventions and international conventions. In furtherance of this research, the effectiveness of these laws and conventions are examined as well as the challenges limiting its effectiveness. There have been some instances which have been revealed by this research where the law has brought to book perpetrators of this act, some others are pending due to the delay of the judicial process and others unreported because of several constraints such as non-compliance, non-implementation etc. Finally, recommendations are provided for in this research on how the legal framework can be more effective so as to reduce the occurrence of this act, curb it’s widespread and preserve lives and destinies from death.
