ABSTRACT
This research examines the doctrine of Negligence with respect to Medical Practice in Nigeria. The research employs the use of the doctrinal research method and reviews case laws, journal, articles, textbook, statutes as well as well as websites on the subject matter. The research finds that medical negligence is on the rise in Nigeria and there is a reluctance of victims, the family of the victim and on the part of the judges to hold medical practitioners liable for Negligence. This research thus recommends that there should be sensitization of the populace on the rights to proper medical care and the medical practitioners must be diligent in the discharge of their duties in providing care to patients. The research thus concludes that until medical practitioners who are reckless in the discharge of their duties are held accountable, there would be a continued rise of medical negligence cases.
