ABSTRACT

In many countries, people with disabilities are often deprived of their rights. They are subjected to discrimination. This research examines the Convention on the Rights of Persons with Disabilities. The Convention on the Rights of Persons with Disabilities is an international human rights instrument, which aims to protect the dignity and rights of individuals with disabilities. This project seeks to bring to light the relevant provisions of the Convention on the Rights of Persons with Disabilities, and the barriers to the implementation of the Convention on the Rights of Persons with Disabilities. It is shown from the research that the Convention protects the rights of all people with disabilities in all areas of life including access to justice, personal mobility, independent living and freedom of expression, through its Articles. The Convention on the Rights of Persons with Disabilities is a major step towards changing the perception of disability and ensures that individuals respect people with disabilities rather than evoking sympathy. However, the absence of national laws is one of the biggest obstacles to ensuring people with disabilities are recognized as equal citizens and their rights upheld, especially in Africa. The challenges that disabled persons encounter are daunting and underpinned by deep-seated and entrenched negative social attitudes regarding disability issues and disabled people. Therefore, this research recommends that there should be enactment of laws that will prescribe penalties for any organization that discriminates via policies and practices or limit the rights and privileges of the physically challenged. Also, there should be regular sensitization and awareness campaign on the need to promoting the rights of the physically challenged and eliminating negative perceptions towards the physically challenged, and concludes that states must intensify their advocacy efforts to put pressure on the government to enact and implement a Disability Bill. In order to achieve this goal, they must be united and coordinate their advocacy activities and strategies.
