ABSTRACT
This research examines the Treaty prohibiting nuclear weapons, its importance and it’s short-coming. The Treaty on Prohibition of Nuclear Weapons (TPNW), recently initiated has been faced with series of challenges as opposed to the Nuclear Proliferation Treaty (NPT). The major reason for this proposal which is mainly from the five nuclear weapon States is its objective, which is to completely prohibit all ‘State parties’ the use, threat to use and further production of nuclear weapons. For this reason, they have refused to sign up to the new treaty choosing rather to stick with the NPT which does not prohibit further production of these weapons by these States. This research explains the necessity for the disarmament of nuclear weapon because of its catastrophic history that may not be justified. Furthermore, this research recommends that the ban of nuclear weapons should be considered customary international law so as to curb the powers of the Nuclear weapon States whether or not they sign the treaty and the research concludes by recommending that there be a treaty providing for the compete eradication and elimination of nuclear weapons due to its irreparable and long term effects.
