ABSTRACT
This research work appraises the abolition of capital punishment under international law. This work examines that the retention of capital punishment is contravening an international fundamental human right, which is the right to life and the right to live from torture, this right have been clearly protected under various international laws. This work further went ahead to sort out the already existing laws, treaties and conventions that provide for the abolition of capital punishment under international law. These laws fall under the categories of international and regional laws. These laws are also being examined to know the origin of their enactment, reasons for their enactment and under what various jurisdictions that they apply. More so, this research work also did buttress further by examining how the various applicable laws prohibiting capital punishment have been effective in the different jurisdictions that they are applicable, and how the various commissions and regional courts that enacted the applicable laws and administer justice in regards breaches of human rights work effectively to ensure that the abolition of capital punishment is adhered to. On a final note, recommendations are provided for on this research work on how capital punishment can be fully abolished under international law, by providing a law that is applicable and binding by all states in the international sphere.
