ABSTRACT
The drive of every government to maintain standard medical practice and procedure by Medical Practitioners is a critical factor to the sustainable existence of a nation, including the workforce and development of the economy. Every government provides an enabling environment for the healthcare system. The main objective of this work was to bring to the public domain the need to know their rights with respect to medical procedure in Nigeria and to create a platform that will enable patients enforce their rights as well as to boost public confidence in the medical healthcare system in Nigeria. This work focused on medical procedure in Nigeria as well as the conceptual framework on patients’ rights and the healthcare procedure, liabilities, legal remedies available to the patients, the relevant laws and regulatory bodies that protect the legal rights of patients. In this work, the doctrinal approach was adopted, the existing literature analysis will be done. This work examined the protection of the patients, in order to strengthen the protection of patients’ rights in medical procedure in Nigeria. Some recommendations were presented in this work, which include, public enlightenment and education of patients on their rights, laws that regulate the rights of patients should be enforced, the use of Alternative Dispute Resolution, Accountability on the part of medical personnel, availability of sufficient compensation for patients, proper functioning of regulatory institutional bodies, all of these should be improved and if properly implemented, it is hoped that the citizen’s legal rights as patients will be well-protected and there will be lesser risks in medical procedure. This work contributes to knowledge by advocating the necessity of enlightening patients on their legal rights in respect of medical procedure in Nigeria.
