AN APPRAISAL OF THE ROLE OF THE POLICE FORCE IN THE ENFORCEMENT OF HUMAN RIGHTS IN NIGERIA

ABSTRACT

The police force is charged with the responsibility and duty of maintaining public safety and public order; they owe a duty of securing and ensuring compliance to the laws. This research adopts a doctrinal methodology and it delves into the abuse of powers by the police and non-fulfillment of their roles and duties, while examining the gross violations of human rights by the police during the course of their statutory duties. The Police Force is obligated to providing a safe community and ensuring that individuals aren’t violating the laws. However, in the cause of performing their duties, individuals’ rights are violated. This research examines the administrative laws and legal provision aimed at protecting human rights and regulating police conducts. This research focuses on the pattern of abuses within the police force which individuals go through and this gross abuse of human rights was undermining the trust of the public and disregarding the obligation to uphold and implement both international norms and local human rights, laws such as African Charter on Human and Peoples’ Right, Universal Declaration of Human Rights Act 1948. To address this issue, the research finds that implementing comprehensive police reforms that prioritize accountability, transparency, and professionalism, increase salaries and provide necessary equipment to enhance police capabilities and reduce corruption and strengthen oversight mechanisms to monitor police conduct and ensure compliance with human rights standards. In conclusion, the Nigerian legal system should adopt the RRR approach which involves rethinking policies, challenging societal attitudes towards the laws put for the protection of the individual rights.
