ABSTRACT
The human passion for the procreation and perpetration of lineage has remained since the existence of man. In light of this fact, several alternatives have been proferred to prospective parents for natural child conception and pregnancy.
One of such alternatives is Surrogacy which implies the use of a substitute mother to gestate a pregnancy for another woman, who subsequently relinquishes the child/children and any parental entitlement to the child/children to the commissioning parents. It is a veritable option for couples who have not been successful in their efforts to bear children.
Another is Artificial Insemination which is a reproductive technology, which involves the introduction of sperm into a woman's reproductive tract (usually the uterus) to facilitate fertilization of an egg.
Before undergoing artificial insemination, both partners may undergo various fertility tests and evaluations to determine the best course of action. In cases where the male partner's sperm is not viable, donor sperm from a sperm bank may be used.
It's important to note that the success rates of artificial insemination can vary, depending on the specific circumstances and the age of the woman. As with any medical procedure, there are potential risks and side effects associated with artificial insemination. It is therefore so crucial to consult with a qualified healthcare professional to discuss individual options and risks.
This research work explores both Surrogacy and Artificial Insemination; the legal framework, issues and it's concerns.
Contemporary medical technology has made extraordinary advances in responding to the desire of women and men to have children. The success of these clinical advances in developing countries, especially Nigeria, has made it possible for couples, who would otherwise have been unable to conceive and bear children, to avail themselves of the techniques commonly grouped under the heading, Assisted Reproductive Technologies (ART).
These advances have also brought with them legal, ethical, social and religious implications. There are various legal questions surrounding the legality of the whole process. This has brought with it, questions as to the right of parties involved and most importantly, the status and rights of children conceived through the process of Artificial Insemination.
This research and analysis would be executed with the aid of primary and secondary research tools, local and foreign literature, as well as online research relating to the subject area and scope of this research paper.
