ABSTRACT
This research work examines the age old use of capital punishment which has been employed as a form of punishment for various degrees of offences. This phenomenon has continued to exist even through modern civilization, and is being used by several countries around the globe today. In Nigeria, capital punishment is and has remained an integral part of our criminal justice system, used as an arrow head for punishing offenders who commit offences classified as capital offences. However, the issue of capital punishment has continued to generate controversies, heated debates and arguments in Nigeria. The thrust of this research is to examine critically the general concept of capital punishment, an appraisal of various theories, the validity and sustainability of capital punishment in Nigerian justice system, issues arising from the application of capital punishment, its effects, justifications and implications. This study examines the various arguments in favour of the continued retention of death penalty and those against it, in light of the prevailing circumstances in Nigeria and draws a conclusion as to whether the need still persist for the retention of death penalty in our legal system. Finally, this research recommends that the society invest more time in fixing the various bugs the death penalty contains, in order to have more benefits from it in the long run. The law should be reformed to make the implementation of capital punishment swift and effective. However, in the execution of a convict, a thorough and due process of law should be followed to avoid the situation where the innocent are executed for the crime they did not commit.
