ABSTRACT

Human Rights issues over time have become a global concern, gaining international relevance. States remain primarily responsible in international law for the promotion and protection of human rights. Nigeria has put in place standard institutional groundwork in line with those of the international framework. Despite this, the judiciary still remains at the centre because it wields enormous powers in the interpretation, enforcement and protection of Human Rights. The judiciary is disposed with a wide range of remedies meant for restoring Human Rights violations occurring in its territory. This research examines the role of judiciary in protecting Human Rights in Nigeria; the study also examines the procedure for the activation of judicial remedies as well as the different challenges which have seriously weakened, compromised and frustrated the effectiveness of the remedies. The study concludes by providing recommendations which will ensure that the remedies are of real value in redressing human rights violations in Nigeria such the extension of jurisdiction to Magistrate courts to hear cases of human rights violations but subject to the supervision of High Courts, because Magistrate courts are established in virtually all the local government areas of the country unlike High Courts which are mostly concentrated in urban areas and also, full independence/autonomy should be granted the judiciary so they can aptly preside over Human Right cases that has to do with the executives without fear or favour.
