ABSTRACT

The Nigerian state has over the years witnessed a host of landmark election petition decisions which have altogether led to and spurred the enactment of the comprehensive Nigerian Electoral Act 2022. This Act, which was a marked improvement on the former Electoral Act, featured several innovative provisions which have been hailed as very significant and particularly important toward achieving a more cohesive body of electoral law in Nigeria. The recently decided case of Adegboyega Oyetola v. Independent National Electoral Commission, which was decided based on the new Electoral Act 2022, thus represents the perfect opportunity for a critical appraisal of the Act, its significant innovations, and how well they have been applied and followed in the Nigerian electoral landscape. Provisions shall equally be made for the identification of chinks in the armory of the new legislation, and how those deficiencies may be improved upon. Given that electoral principles remain the same, several other decided cases would be equally relevant in this long essay, all towards the primary aim of providing a comprehensive analysis of the Electoral Act 2022, alongside the impact of the case of Adegboyega Oyetola v. Iindependent National Electoral Commission on the electoral terrain, and a deep analysis of the potential emerging issues from this case on all relevant parties.
