AN ANALYSIS OF FREEDOM OF EXPRESSION IN NIGERIA: A CASE STUDY OF END SARS PROTEST

ABSTRACT

The flagrant disregard of human rights in democratic Nigeria by so many governmental agencies and state actors despite the various legal frameworks protecting human rights casts doubt on the efficiency of real democratic practice in Nigeria. This study analyses the role of protest, freedom of expression and the press in the protection of citizens in a democratic Nigeria, with the EndSARS protest in view. The doctrinal research methodology was adopted for the study to analyse the legal framework for freedom of expression, protest and the press internationally, regionally and locally. The study finds amongst others that there are limitations or gaps in the right of freedom of expression, protest and freedom of the press under the Constitution. The study also finds that the enforcement of the right of expression and the Nigerian press is problematic. This shows that even though press freedom is guaranteed in the constitution of Nigeria, it is only rhetorical as there are techniques used by government in Nigeria to circumvent what has been guaranteed in the constitution. The study therefore recommends that as a matter of urgency,The Public Order Act should be revised to include a provision that guides the activities of both the citizens and law enforcement agents during protest amongst others. The study concludes that freedom of expression press and protest are regarded as a cornerstone of democracy as it ensures the consolidation and development of democracy.
