ABSTRACT

In our world today, homosexuality and same-sex marriages are not a new phenomenon. It is a matter that is of age of practice, even as old as time itself.  This project lays emphasis on consensual activities between adults of the same-sex, which has become a topic of discussion; whether or not to embrace it or to discard it. This study looks into the emergence of homosexuality, and same-sex marriage, its historical background in Nigeria and various foreign jurisdictions. It is obvious by the positions of legal frameworks such as the Same-Sex Marriage Prohibition Act 2013, The CriminalCode, the Penal Code and the 1999 Constitution stress that Nigeria does not only deem it unacceptable but criminalises such activity. It has been as an absurd behaviour and one which causes social disintegration in the eyes of morality. Furthermore, this study recognises how religion and customs/traditions is affected. Looking into legislations, conventions, treaties held in the international realm on such matters and how they try to cajole other countries to welcome this ideology, arguments for and against this case study will be considered. There will also be a comparative and jurisprudential analysis on the subject by intersecting both the Nigerian law and other various foreign jurisdictions; bearing in mind that this study unequivocally supports the Nigerian system, arguing from a moral point of view.
