SUMMARY
It is not a fact that section 84 (12) of the Electoral Act 2022 is constitutional, it is deemed unconstitutional as the section offend a section of the constitutional provisions, the constitution is supreme, Section 1(1) and (3) of the constitution of the federal Republic of Nigeria, 1999 (as amended)[1] provides: ' that the constitution is supreme and its provisions shall have binding force on all authorities and person through out the federal Republic of Nigeria, subsection (3) provides that if any law is inconsistent with the provisions of this Constitution, this constitution shall prevail, and that other law shall to the extent of the inconsistency be void’ it therefore mean that no other law can override the constitutional provisions. Further more, the two aspect of section 84 (12) of the electoral Act 2022 which are as voting delegate and as Aspirants.
