ABSTRACT

This research work appraises the contribution of the International Criminal Court in its fight against impunity in Africa and portrays zero tolerance of the Court to the most serious crimes. This research discovers that African States disagree with the Channel of ICC’s investigations as it appears that all investigations and prosecutions by ICC have been against African States. This brings up allegations against the ICC being a racist court which targets African States rather than a global Court whose main aim is to fight impunity in all parts of the world. The allegations against ICC by African States led to some African States threatening to pull out from the ICC which was perfected by Burundi thus these allegations also lead to the formation of the African Court of Justice and Human and Peoples Right. However, this research recommends that African States should disregard the notion of ICC being a racist Court and support the ICC to curb the commission of the most serious crimes, a real implementation mechanism for monitoring situations of the commission of such crimes. Finally, this research concludes that the formation of a regional Court is clearly not the solution to impunity or Africa’s agitation against the ICC; but effective cooperation with the ICC and adoption of measures to prevent such atrocities will go a long way in addressing the disagreement between Africa and the International Criminal Court.
