ABSTRACT

In the current era of digital transformation, safeguarding personal data is paramount. The Nigeria Data Protection Act (NDPA) 2023 stands as a pivotal piece of legislation in this regard, guiding the processing and safeguarding of personal data in Nigeria. The NDPA became effective on June 12, 2023. Prior to the enactment of the NDPA, Nigeria's data sphere was managed by the Nigerian Data Protection Regulation (NDPR) 2019. This was a set of regulations issued by the National Information Technology Development Agency (NITDA). This study aims to conduct a comparative analysis of the NDPA 2023, evaluating its effectiveness in safeguarding personal data. This study will examine the key provisions of the NDPA and compare them with other international data protection laws such as the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), Personal Information Protection and Electronic Documents Act (PIPEDA), Personal Data Protection Act (PDPA), and the Lei Geral de Proteção de Dados Pessoais (LGPD). This comparative assessment identifies the strengths and weaknesses of the NDPA. One notable challenge faced in the enforcement and compliance of the NDPA is the lack of awareness. Therefore this research provides case studies on its impact on personal data protection. Through this comparative analysis, this research seeks to provide insights into the NDPA's impact on the protection of personal data for Nigeria's diverse population of over 220 million individuals.
